In Western Tradition Partnership Inc. v. Attorney General, the Montana Supreme Court upheld Montana’s ban on corporate independent political expenditures, in the face of the United State’s Supreme Court’s ruling in Citizen United v. Federal Election Commission. The Montana Supreme Court adopted the rather bizarre argument by Montana officials that they and their fellow politicians were so uniquely corrupt, and their constituents so uniquely incapable of voting corrupt politicians out of office, that Citizens United v. FEC didn’t apply in Montana. CCP submitted an amicus brief to the Montana Supreme Court, which was cited in one of the dissenting opinions.
