First Choice Women’s Resource Centers is a Christian medical nonprofit serving pregnant women, new mothers, and fathers. The Attorney General of New Jersey has specifically singled out this organization due to its religious beliefs and pro-life stance. New Jersey thus issued a sweeping and unjustified subpoena, demanding extensive documentation from the nonprofit. This places a heavy burden on the organization, forcing it to allocate its limited resources to comply or face legal consequences. Despite this, the Attorney General has not provided any concrete evidence of wrongdoing to warrant such intrusive measures.
The Institute for Free Speech joined the Manhattan Institute, the Texas Public Policy Foundation, the Animal Activist Legal Defense Project, and the People United For Privacy Foundation as amici curiae authoring a petition for a writ of mandamus to The United States District Court for the District of New Jersey supporting the petitioner.
In November 2024, the Institute for Free Speech joined the Manhattan Institute and Religious Freedom Institute in filing a second amicus brief, this time urging the U.S. Court of Appeals for the Third Circuit to protect donor privacy by finding First Choice’s First Amendment claims ripe and granting an emergency injunction to prevent compelled disclosure of over 5,000 donors’ personal information.
